ScamShield provides an AI-powered tool designed to assist users in identifying potentially fraudulent physical mail. Users may upload photographs of mail items, which are analyzed by artificial intelligence algorithms to provide an assessment of potential fraud indicators.

- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY ANALYSIS OR RESULTS
ScamShield is not a substitute for professional legal, financial, or security advice.The AI-generated assessments are informational tools only and should not be relied upon as the sole basis for any decision. We strongly recommend consulting with appropriate professionals and law enforcement regarding suspected fraud.
AI Limitations: Our artificial intelligence system, while designed to identify common fraud patterns, may produce false positives (identifying legitimate mail as fraudulent) or false negatives (failing to identify fraudulent mail). No AI system is infallible, and results should be considered as one factor among many in your assessment.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCAMSHIELD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
- ANY FINANCIAL LOSSES RESULTING FROM RELIANCE ON THE SERVICE'S ANALYSIS
- ANY DAMAGES ARISING FROM FRAUD THAT WAS NOT DETECTED BY THE SERVICE
- ANY DAMAGES ARISING FROM LEGITIMATE MAIL INCORRECTLY IDENTIFIED AS FRAUDULENT
- ANY ACTIONS TAKEN OR NOT TAKEN BASED ON THE SERVICE'S ASSESSMENTS
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless ScamShield and its officers, directors, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Any content you upload to the Service
- Any actions you take or fail to take based on the Service's analysis
6. User Responsibilities
By using the Service, you agree to:
- Provide accurate information when creating an account
- Use the Service only for lawful purposes
- Not upload content that infringes on third-party rights
- Not attempt to circumvent any security features of the Service
- Not use the Service to harass, abuse, or harm others
- Exercise your own judgment and seek professional advice when dealing with suspected fraud
- Report suspected fraud to appropriate authorities (law enforcement, postal inspectors)
7. Data Processing Consent
By using the Service, you consent to the processing of uploaded images by our AI systems and third-party service providers as described in our Privacy Policy. You represent and warrant that you have the right to upload any images you submit and that doing so does not violate any applicable laws or third-party rights.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by ScamShield and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any images you upload but grant us a limited license to process them for the purpose of providing the Service.
9. Termination
We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
10. Dispute Resolution and Arbitration
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Delaware, and the arbitrator's decision shall be final and binding.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
12. Severability
